TOPIC: Dr. Elist threatens ThundersPlace with lawsuit

Dr. Elist has hired an attorney to threaten ThundersPlace.org with legal action if it does not remove a thread made by forum member \"txhog\" detailing the surgery he had with Dr. Elist.

I thought you guys might find this interesting and it is of particular importance to this board as one of the demands laid out by Dr. Elist\'s attorney is that ThundersPlace will \"...cease and desist from any further derogatory postings of any kind about Dr. Elist\", which I would imagine would also include patient reports of procedures performed by Dr. Elist that could be deemed negative.

ThundersPlace is a small non-profit community dedicated to the open discussion of non-surgical penis enlargement. If any one reading by any chance has experience with cases like these TP would appreciate your help.

This is bullying and \"thuggery\" (as one blog puts it), at its finest. There isn\'t a whole lot of legal ground they stand on, so it\'s doubtful they\'d actually pursue any sort of litigation. Their angle must be intimidation & scare tactics...which is downright unfortunate & disappointing. Just because you have an ego & a bank roll doesn\'t mean you should frivolously threaten these online PE forums... especially given that any objective observer can see that no such defamation is condoned or tolerated.

I applaud Thunder\'s team for announcing this publicly as they did txhog\'s (Thundersplace username) progress report. Given that they have a much larger audience & membership than we have here, more people may get involved, and hopefully, things will be righted.

Dr. Elist can\'t sue anyone for speaking the truth. First off, it is every person\'s First Amendment Right to freedom of speech and speak out on a topic for which they experienced, so long as the statement is true. Secondly, libel and slander are only meritorious when the statements made are both false and damaging. Accordingly, if the member on ThundersPlace is speaking the truth, there is no cause of action for libel/slander since a truthful statement is an absolute affirmative defense to this form of tort.

Basically, if Elist sues, he\'s initiating a SLAPP case. A SLAPP suit is a strategic lawsuit against public participation (SLAPP) that is intended to censor, intimidate, and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition. Thankfully, there are Anti-SLAPP motions/countersuits that basically punishes people like Dr. Elist if he files suit to silence the truth. An anti-SLAPP suit/motion could cost him tons of cash, so his attorney better be aware of that, or his attorney could be on the fringe of malpractice for advising Dr. Elist to file suit.

Is unbelievable that in that in 2016 this man is still getting away with this, it\'s as if he\'s above the law, surley he should be in prison.

I have not only Elist operative report, but also Dr Alter\'s who removed the implant and Dr Gelman\'s who corrected residual curvatures

and all the photos to go with it. So I can prove all I say it\'s true.

Elist offered me a longer penis (which was perfectly normal at little over 6.5 inches in length, and in the end I\'m 2,5 inches shorter. I\'m devastated, can\'t even

wear a condom because it falls off.

I have said this before and I\'ll say it again. If any one needs a witness to elist\'s unethical destructive surgery or need help in their law suit I am 100% ready to help them in any way I can. Going public is what I want, I am not scared of anyone.
